RN with Simple Battery Conviction that's 5 Years Old

Hi, I was was looking at similar posts from other users but couldn't find any that offered any advice on my situation. 6 years ago at the age of 19 I was placed on probation for Disorderly Conduct.I violated my probation by getting into a fight 10 months later with my then boyfriend. He called the police on me and I was arrested because he didn't have a criminal history (at the time) and I was arrested for probation violation and simple battery from the fight I had with him. I served 43 long days in jail for the violation charge and received time served for the simple battery charge. (All of which happened in Georgia) Now I'm almost 26 years old and it's still haunting me!! 4 years ago, I married a wonderful man and we relocated to Louisiana. I'm having a hard time even finding a job as a CNA (I've had my cert. for about two years now) I've completed my prereqs and currently awaiting my approval into the BSN program here at McNeese State and I'm starting to wonder what should I do. I've been told that because I have violent convictions that I won't be able to get into the nursing program and I'm starting to believe these things. I mean, I can't even get anyone to hire me here as an CNA. What should i do? It's been 5 years...

Sorry for the long story. Thanks, Ashley

Look in at state board of nursing website they should have a handbook on the web which states what what misdeamnors or felonies will keep you from the exam. I am in texas and most misd will not after 5years. But keep in mind the board looks at each case on a “case to case basis”

I am a nurse recruiter, and I can see how this past mistake is holding you back. I would contact the court in Georgia and see if there is a possibility that you can have it expunged from your record.

Sorry it took so long to respond..

@Ann Thanks so much for responding! I looked into it and thankfully my state (Louisiana) won’t hold my charges against me! Yayyy!! I WILL be able to complete nursing school and sit for the NCLEX testing. I’m sooo excited and look for to my career choice! =)

@Nurse Recruiter Thanks so much for responding! This incident is holding me back NOW but I’m NOT giving up, EVER! LOL However, this charge can’t be expunged because I was covicted. Georgia won’t expunge any convictions no matter how old they are. They won’t even expunge convictions if the convicted individual prove that they’ve learned from their mistakes. But I will try to keep a positive attitude. I hope when I gain my licensure that whichever facility or company I apply to doesn’t hold this against me.

My other concern is completing my clinicals. I understand that the state will allow me to sit for testing but I’m worried that my clinical site won’t be so forgiving. My sister recently completed nursing school in Georgia and she told me that a few of her classmates couldn’t go to clinicals because of their background checks. Does anyone know what I should do about this? I’ve come too far to turn back and nursing is where my heart is..
